Welcome to On Call Home Warranty (“Company,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website, services, and home warranty plans. By accessing or using our website and services, you agree to be bound by these Terms. 

1. Definitions

  • “Customer” refers to any individual or entity purchasing a home warranty plan from us. 
  • “Covered Items” refers to appliances and systems protected under our warranty plans. 
  • “Service Provider” refers to third-party technicians or contractors we dispatch to perform repairs or replacements. 

2. Eligibility

To purchase a home warranty plan, you must be at least 18 years old and reside in an area where our services are offered. By using our website and services, you confirm that you meet these requirements. 

3. Home Warranty Coverage

  • Coverage is limited to the items specified in your plan agreement. 
  • Coverage is subject to exclusions and limitations outlined in the plan. 
  • Pre-existing conditions or improper installations may not be covered. 
  • Customers must maintain covered systems and appliances in accordance with manufacturer recommendations. 

4. Claims Process

  • Claims must be submitted through our website or customer service hotline. 
  • We reserve the right to determine whether to repair or replace covered items. 
  • Unauthorized repairs will not be reimbursed. 

5. Service & Response Times

  • We strive to dispatch service providers within a reasonable timeframe in the instance you do not have a service provider. 
  • Emergency services may be available at an additional cost. 
  • Availability of service providers may vary by location. 

6. Limitations of Liability

  • We are not liable for incidental, indirect, or consequential damages arising from covered repairs or replacements. 
  • The total liability under any claim is limited to the amount paid for the current warranty term. 
  • We do not guarantee uninterrupted or error-free access to our website or services. 

7. Payments & Renewals

  • Home warranty plans require payment in advance. 
  • Subscriptions automatically renew unless canceled before the renewal date. 
  • Failure to make timely payments may result in plan suspension or cancellation. 

8. Cancellations & Refunds

  • Customers may cancel their plan within 30 days of purchase for a full refund, minus any service fees incurred. 
  • After the initial cancellation period, pro-rated refunds may be issued. 
  • We reserve the right to cancel any plan due to fraud, non-payment, or misuse of services. 

9. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of On Call Home Warranty, LLC and protected under applicable intellectual property laws. Unauthorized use is prohibited. 

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of Oklahoma. Any disputes arising under these Terms shall be resolved through arbitration in Tulsa, Oklahoma, except where prohibited by law. 

11. Changes to These Terms

We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of the revised Terms.
